Michigan law requires that child support be calculated pursuant to the Michigan Child Support Formula. In calculating the amount of support that should be paid, the formula looks at each parent’s net income, the number of children requiring support and the amount of overnights that each parent has with the children on an annual basis. Essentially, the formula performs a balancing act of sorts by allotting the children a portion of the family’s income by considering the needs of the children being supported and the parents’ actual resources.

The task of calculating support is often performed by the friend of the court and sometimes by the parties’ attorneys. However, calculating support can prove to be problematic at times, as parents will often attempt to understate their incomes, and/or voluntarily reduce the same, in an effort to maximize or minimize the amount of support that is required to be paid. Thankfully, Michigan recognizes imputation (constructive income) as a method of proving a party’s income.
