Man Accepts Responsibility for Fatal Traffic Crash Involving Motorcyclist
A tragic incident unfolded on September 10, 2022, when a motorcyclist lost his life in a crash involving a motorcyclist on Highway 52 near Orion Township. The driver responsible, 59-year-old Nicholas Allen Sprau from Chatfield, has recently pleaded guilty to criminal vehicular homicide and driving while intoxicated (DWI).
The accident occurred just before 10 p.m., claiming the life of 36-year-old Rochester resident Ricky Hutton. Following the crash, a memorial for Hutton was placed on Highway 52 but later disappeared, adding to the family’s grief.
In the legal proceedings, Sprau’s guilty plea is contingent upon the court’s sentencing decision. If the sentence exceeds 41 months, he retains the right to withdraw his plea. Two additional charges of criminal vehicular homicide have been dismissed as part of the plea agreement.
Victims of such tragic incidents, like the family of Mr. Hutton, may be entitled to various forms of compensation. This compensation can cover medical expenses incurred before death, funeral and burial costs, loss of income, loss of companionship, and emotional distress.
In Michigan, the no-fault insurance system presents unique challenges for motorcyclists seeking compensation. Generally, motorcyclists cannot access no-fault benefits unless the accident involves a motor vehicle with personal injury protection (PIP) coverage. In such cases, injured motorcyclists can seek compensation up to the at-fault driver’s no-fault policy limits.
